Registering a Texas Architecture Firm with TBAE: LLC, PLLC and the $45 Annual Registration

01 / The direct answer

Forming the LLC or PLLC is not the TBAE business registration. Firms offering or providing architectural, registered interior design or landscape architecture services register annually with TBAE, including a correspondence email. The initial and annual fee is $45; a multidisciplinary firm pays one fee. Occ. Code § 1051.701(b) requires architectural work to be performed by or through a registered architect. We do not file the TBAE registration.

Start with the right question.

Who performs the work?

An entity may practice or advertise architecture only if the work is performed by or through a registered architect (Occ. Code § 1051.701(b)).

Official source: https://tbae.texas.gov/business-registration/

What does the online application ask for?

The EIN and the TBAE registration numbers of the architect(s), with a correspondence email.

What if the firm dissolves or loses its architect?

Notify TBAE within 30 days under 22 TAC § 1.124(c). The firm may continue only if it retains an architect and updates within 30 days.

03 / Before you proceed

Your preparation checklist

  1. Confirm a registered architect will perform or supervise the architectural work through the entity.
  2. Form the LLC or PLLC with SOS Form 205 or Form 206 ($300 state fee).
  3. Obtain the EIN for the online business registration.
  4. Collect the architect(s)’ TBAE registration numbers and a correspondence email.
  5. Register the business with TBAE and pay the $45 initial fee; we do not file this registration.
  6. Renew on the anniversary each year for $45.
  7. Notify TBAE within 30 days if the firm dissolves or loses its architect; retain an architect and update within 30 days to continue.
Common trap: Using “Architects” in the LLC name before a registered architect is on board.
Common trap: Letting the anniversary lapse: the late renewal fee doubles after 90 days.
